This article applies to leders, forwarders and agencies 



Starting January 1st, 2024 repossession agents in the state of Illinois will be responsible for clearing privacy data from the vehicle.

To accommodate this new law MBSi has added additional Personal Property fields in both RecoveryConnect and RCM.

 

 

 

Data will be considered personal property so you must mark "Yes" in the Personal Property field to activate the Privacy Data fields.

 

Privacy Data Removed can be marked as Yes, No, or Not Applicable.

 

The Privacy Data Removal Information box is a free text field where agents can make notes and leave certificate numbers indicating the data has been removed.

 

Privacy Data Reporting

You can report on Privacy Data Fields in My Reports.

 

Under the Data Criteria page, you can search for cases where privacy data was marked Yes, No, or Not Applicable.

 

For recoveries marked before January 3rd, 2024 (the date of MBSi's release with this functionality) the privacy data will be marked as null (not the same as Not Applicable).

 

 

You can add both Privacy Data Removed (330) and Privacy Data Removal Information (331) via Displayed Columns to populate this data to your reports. 

 

Standard Invoicing 

To support your billing efforts with this new service type we have created the default service fee “Privacy Data Removal”. 

 

You can create this billing item by selecting “Privacy Data Removal” as your default service fee type. 

 

If your lender is unable to consume the new fee type in their internal systems you may need to select “Admin Fee” as your default service fee instead.

 

 

Double-check with your clients to make sure they're prepared to handle this new fee type in their internal systems. If they tell you they are not, you can change the default service fee to "Admin Fee".

 

If your client is using Smart Invoicing they will handle the fee by updating their contracts.
